Article 1 – Definitions

In these Terms and Conditions:

Cooling-off period: The period in which a consumer may exercise their right to return.
Consumer: A natural person not acting in a professional or commercial capacity who enters into a distance contract with the trader.
Day: A calendar day.
Continuing performance contract: A remote agreement for recurring deliveries of products and/or services over time.
Durable data carrier: Any tool that allows the consumer or trader to store information in a way that permits future reference and unchanged reproduction.
Right to return: The option for the consumer to cancel the distance contract within the cooling-off period.
Trader: The legal entity offering products and/or services remotely to consumers.
Distance contract: An agreement concluded within an organized remote sales system using one or more distance communication techniques.
Technique for distance communication: Any tool used to conclude a contract without the physical presence of both parties.
General Terms and Conditions: These Terms and Conditions of the trader.

Article 3 – Applicability

These Terms and Conditions apply to every offer, order, and distance contract between Avelique and the consumer. They are provided prior to the conclusion of the agreement and can be saved on a durable medium.

If the agreement is concluded electronically, the terms will be made accessible in a manner that enables storage and future access. In the event of conflicting conditions, the clause most favourable to the consumer shall apply.

Should any provision prove invalid, the remainder remains fully enforceable. The affected clause will be replaced by a valid one that aligns as closely as possible with the original intention.

Article 4 – The Offer

All offers are non-binding unless stated otherwise. Limited-time offers or offers under specific conditions will clearly indicate such limitations.

Product descriptions and images are prepared with the greatest care, though slight deviations in colour may occur.

Offers include clear details on pricing, shipping costs, order process, return rights, payment, and delivery terms.

Article 5 – The Contract

A contract is concluded when the consumer accepts the offer and complies with the conditions set.

For electronic transactions, the trader will confirm receipt without delay. Until confirmation is received, the consumer may cancel.

Orders may be declined with reasonable justification.

Upon delivery, the consumer receives all essential contract details in writing.

Article 6 – Right to Return

The consumer may withdraw from the contract within 30 days after receiving the product, without providing a reason.

Items must be returned in unused, original condition, with packaging and tags intact.

The consumer must notify the trader by email or in writing and return the product within 30 days. Failure to notify or return within the timeframe finalises the purchase.

Article 7 – Costs in Case of Return

Return shipping costs are the responsibility of the consumer, unless the item arrived damaged, defective, or incorrect. The purchase amount will be refunded within 14 days of receipt of the returned item.

Article 8 – Exclusion of the Right to Return

The right to return does not apply to:

  • Personalised or custom-made products
  • Perishable goods
  • Sealed hygiene or personal-care products once unsealed
  • Sale or discounted items (where indicated)

Article 9 – The Price

Prices are fixed during the validity period of the offer, unless tax rates change.

For price increases taking effect after three months, the consumer is entitled to cancel the contract.

Article 10 – Conformity and Warranty

Products conform to the agreement, the product description, and applicable legal requirements. Warranty does not cover misuse, normal wear and tear, or unauthorised repairs.

Nothing in these terms limits any rights the consumer has under applicable consumer protection law.

Article 11 – Delivery and Execution

Orders are fulfilled with due care and delivered within the estimated timeframe stated in our Shipping Policy. Where delivery is delayed beyond a reasonable period, the consumer will be informed and may cancel for a full refund.

Risk of loss or damage transfers to the consumer upon delivery.

Article 12 – Continuing Performance Contracts

Open-ended agreements may be cancelled at any time with one month's notice. Fixed-term contracts are not automatically renewed unless legally permitted.

Article 13 – Payment

Orders are paid in full at the time of purchase through the payment methods offered at checkout. Where a payment error occurs, it must be reported to us immediately at support@aveliqueco.com.

If payment is not successfully completed, the order may not be processed or dispatched.

Article 14 – Complaints Procedure

Complaints may be submitted to support@aveliqueco.com. We aim to acknowledge complaints promptly and to provide a substantive response within 14 days.

If no satisfactory resolution is found, the consumer may pursue any remedy available under applicable law.

Article 15 – Disputes and Governing Law

These Terms and Conditions are governed by the laws of [governing jurisdiction — see note below].
